Clarence Thomas Takes Supreme Court Spotlight – After Decades-Long Wait, Kavanaugh Could Be His Swing Vote On Roe

This week could produce the very thing Donald Trump sought when he ran for president.
Ever since he appointed three Supreme Court justices, Americans have been waiting for a ruling on a major court case. And that could be coming faster than people expected.

The justices will hear arguments Wednesday over a Mississippi law that bans abortion after 15 weeks in a direct challenge to Roe v. Wade.
How the court rules on this case could have a direct impact on Roe v. Wade. And the leading voice on the bench, Clarence Thomas, is about to have his day.

“Our abortion precedents are grievously wrong and should be overruled,” Thomas wrote in a dissenting opinion in 2020…
“The Constitution does not constrain the States’ ability to regulate or even prohibit abortion,” he added.
Only four justices will probably vote against Thomas, the three liberal justices as well as Bush-appointed John Roberts. The fate of Roe hangs on one man.

Justice Brett Kavanaugh is expected to be the swing vote when the Supreme Court takes up a challenge to Roe v. Wade later this year. A review of the justice’s opinions suggests that he is open to overturning the landmark 1973 decision.
The Supreme Court currently has a 6-3 “conservative” majority. But John Roberts, appointed by President George W. Bush, frequently sides with the liberal win of the court. It is likely he’ll vote to uphold Roe in the upcoming Mississippi case.
Most believe Alito, and the two other Trump appointees, Gorsuch and Barrett will most certainly vote to strike down Roe. Clarence Thomas, the most senior member of the court, could likely chart the path for the conservative wing of the court.
With that 5-4 potential vote, the final verdict could be decided by Kavanaugh. Pro-choice advocates are unsure if Kavanaugh will side with them and uphold Roe or break for conservatives and knock down this decades-old ruling. While he has a long history of conservative rulings, he has written little about abortion.
On top of this, some view him as a “cautious” justice unwilling to make any rulings that will dramatically change the legal landscape of the county. Would he vote to knock down Roe and outlaw this practice at the federal level?
This is what people are debating. How Kavanaugh votes could determine the fate of pro-life laws all over the country.
